1. Introduction – License to Use Website.

For each frame installation project, whose special characteristics are described and uploaded by the customer, the customer receives quotations from the constructors/professionals and freely chooses the concessionaire, that is the one who will take on completion of the project.

3. Term Application.

3.1 These terms apply for using the website kostologisikoufomaton.gr in Greece or abroad.

3.2 The terms are binding only between the user and us. Except where explicitly stated, no provision of these terms will be executed (third party rights) and these terms are not reason for any legal sanctions, claims or other benefits or protection between users or for third parties or with protective influence for third parties.

4. General Clauses.

4.1 While using kostologisikoufomaton.gr the user must abide by and conform to the current laws and clauses included in these terms. This is especially true for the content of data uploaded by the members of kostologisikoufomaton.gr.

4.4 It is prohibited for services and products offered by members to lead or aid in third party deceit or aim to the sale of stolen goods or counterfeit objects.

4.5 It is prohibited for services and products offered by members to infringe on intellectual or industrial property rights, trade secrets, as well as property rights or personality rights.

4.6 It is prohibited for services and products offered by members to conflict with current Greek or European legislation clauses, including clauses pertaining to issues of exports, consumer protection, imperfect competition, discrimination or deceiving advertisement.

4.7 It is prohibited for services and products offered by members to be slanderous, threatening or blackmailing.

4.8 It is prohibited for services and products offered by members to criticize social minorities, population groups and racial characteristics.

4.9 It is prohibited for services and products offered by members to imply or present or be connected in any way to child pornography.

4.10 It is prohibited for services and products offered by members to contain viruses, Trojans, worms, time bombs or cancel bots or any other program code, which may cause intentional damage or data loss to member/visitor computers as well as to the system in general, and they also must not lead to resource or service or operation loss partially or on the whole, connected to our internet providers or other affiliates.

4.11 Apart from the aforementioned, it is prohibited that a member or user creates or participates in project entry connected to services or products whose potential sale either endangers kostologisikoufomaton.gr liability for national or European law infringement, or conflicts with its terms of use and operation rules.

5. Purpose and Expiry of Membership.

5.1 The access to the public fields or the website at kostologisikoufomaton.gr (according to these terms) is free to any user.

5.4.1 The tasks are performed only between customer and concessionaire.

5.4.2 We are not responsible or obligated to receive or process complaints against other members or mediate or resolve dispute between users, except if the complaint is about applying the legal or agreement sanctions to us.

6. Registration – Personal Data Protection.

6.1 As previously mentioned, for a user to receive a quotation or quotations for a specific frame installation project, they need to input their personal data.

6.2 Any data sent to the website, especially information required for a user to receive a quotation or quotations for a project, must be provided fully and honestly. In case of changes of this data, especially contact details, the member must inform us.

6.3 It is not allowed to create more than one member accounts for the same natural or legal person.

6.4 Members who wish to use kostologisikoufomaton.gr for professional use may be asked by kostologisikoufomaton.gr, after their registration, to send a copy of their license (to confirm the registration) to kostologisikoufomaton.gr. Consequently, it is each member’s responsibility to check the personal data of other users. Our company will examine any information for inaccurate data. If verified, we will ask the member for information to correct the data, or we will block or delete this data.

7. General Rules of Quotation Submission Process.

7.1 A project registered by a customer on kostologisikoufomaton.gr must not be assigned in any other way than “Assignment”.

7.2 Members can submit their quotations only through the kostologisikoufomaton.gr website.

7.3 When a quotation is accepted by a customer, for a project registered on kostologisikoufomaton.gr, the parties in agreement – customer and concessionaire – must come in contact directly to complete the project.

8. Uploading Project Terms and Prohibited Project Registrations.

8.1 The registration of a project does not constitute commitment between customer and professional candidates offering quotations.

8.2 It is prohibited to register projects which infringe the law and third party rights.

9. General Quotation Submission Rules.

9.1 The quotations for the realization of a frame installation project registered on kostologisikoufomaton.gr must be submitted only through kostologisikoufomaton.gr, using the corresponding functions provided for this purpose.

9.2 The submission of false quotations which reduce or avoid use fees is prohibited.

9.3 The professional candidate remains engaged by each of his quotations, registered on kostologisikoufomaton.gr, if not withdrawn according to paragraph 10.

10. Registered Quotations Withdrawal and Editing.

10.1 The registered quotations may be withdrawn or modified at any time after user editing, using the corresponding functions provided for this by us, as long as the project has not been assigned. However, if the project has been assigned to a crew/professional, the agreement and explicit consent of the concessionaire is required, in which the user modifications will be accepted.

11. Quotation Submission Process, Quotation Submission Period and Project Cancellation.

11.1 A professional candidate quotation becomes accepted by project Assignment. To assign a project, the customer accepts one of the submitted quotations.

12. Use Fees / Payment Terms.

12.1 Use fees will be imposed ONLY on professionals-crews (NOT customers asking for quotations), according to the kostologisikoufomaton.gr pricelist. The member (professional-crew) who uses kostologisikoufomaton.gr chargeable services is obliged to pay these use fees. The fee schedule may include additional adjustments. Registering a project in any case is FREE OF CHARGE.

12.2 Use fees are the compensation for using the chargeable services of kostologisikoufomaton.gr. We do not guarantee the quality of services offered by concessionaires, regardless of it not existing from the beginning or ceased to exist after delivery. The responsibility of concessionaire appropriateness belongs exclusively to the customer. The obligation for use fee payment is still valid if a quotation submitted on kostologisikoufomaton.gr is eventually not accepted by the customer.

13. Content Responsibility. Our Responsibility.

13.1 The content in the quotation field published on kostologisikoufomaton.gr, is created exclusively by the involved member. The member creating it is exclusively responsible for the content. We examine this content and in case it is illegal, slanderous or impermissible without license, it will be deleted or access to it will be blocked.

13.2 The form and characteristics of the kostologisikoufomaton.gr services may change from time to time. We are not obliged to provide or maintain any special characteristics. Guarantee is not provided for system availability. The system may be restricted partially or wholly due to performing regular or on demand tasks (maintenance or for other reasons, e.g. individual functions). The website kostologisikoufomaton.gr is exempted of any responsibility for potential consequences due to limited availability for quotations that have been made, or for quotations that are impossible to be made in its duration.

13.4 We are not liable to the user for any loss, expense, expenditure or other demands for compensation resulting from any information or instructions provided by members that are either deficient or incorrect or inaccurate.

13.5 We are not liable to the user for any delays in execution, or any non-performance of our obligations if the delay or inability is due to: natural disasters or war or terrorism or authority inability or internet service provision or any other cause beyond our abilities.

13.6 We are not liable to the user for any unforeseeable loss that may emerge.

13.7 We are not liable for any kind of physical injury or death resulting from negligence or user false statement.

13.8 The following paragraph clauses define the total financial responsibility of the professional candidates (including any responsibility for the actions or omissions of employees, agents and subcontractors) regarding:

13.8.1 Any infringement of these terms

13.8.2 Any use of kostologisikoufomaton.gr functions or any of their parts

13.8.3 Any representation, statement or action or offense omission (including negligence) resulting from or connected to these terms.

13.9 According to article 13, we are not responsible for:

13.9.1 Profit loss or

13.9.2 Work loss or

13.9.3 Surplus value exhaustion and/or similar losses or

13.9.4 Non-achievement of the anticipated savings or

13.9.5 Loss of merchandise or materials or

13.9.6 Agreement cancellation or

13.9.7 Loss due to technical issues of data or information or

13.9.8 Any specific, indirect, consequent or clearly financial losses, expenses or expenditure.

14. Professional Candidate (frame constructor) Obligations.

14.1 It is noted that professional candidates uploading their quotation or quotations for a project through kostologisikoufomaton.gr are obliged to be based and produce their products (frame systems) within Greek territory.

14.2 Frame systems installed in every project are explicitly agreed to necessarily bear CE certification. The kostologisikoufomaton.gr administrative company is explicitly stated not to be liable for the quality, properties, individual characteristics of frames, for any legal or actual flaws, as well as for the time and means of their delivery/installation to the customers. The constructor holds exclusive responsibility for all the above.

14.3 It is explicitly agreed that for every quotation submitted on kostologisikoufomaton.gr, professional candidates are not allowed to set a price lower than that defined by the kostologisikoufomaton.gr platform.

15. Modifications / Recurrent Changes.

No modification of these terms will be taken into consideration and will not be part of this agreement, if it has not been put in writing and incorporated to it.

The above terms and conditions, as well as any modification, change or alteration are governed and completed by Greek law. For any conflict that arises from the present agreement, Athens Courts of Law are pertinent.

The user knows/is informed that advertising messages and sponsor messages may be uploaded on the website. In this context, any complaint about advertising material content that is on the website must be forwarded to the directly involved, given that the company bears no such responsibility.
